1. Who We Are

Fairplay Industries Ltd ("we", "us", "our") is the data controller responsible for your personal data. We are a multimedia studio registered in England and Wales, United Kingdom. You can contact us at: connect@fairplayindustries.com

2. Age Requirement

FAIRPLAY ID accounts and our newsletter are only available to individuals aged 16 or over. By creating an account or subscribing, you confirm you are at least 16 years of age. We do not knowingly collect personal data from anyone under the age of 16. If we become aware that we have done so, we will delete that data promptly.

3. What Data We Collect

FAIRPLAY ID Account holders: Email address, optional display name, session records, IP address at login, device/browser information, account creation timestamp, last login timestamp, and marketing preference. Passkey authentication is currently unavailable and no new passkey credentials are accepted.

Newsletter subscribers: Email address, optional name, and marketing consent timestamp.

Website visitors: We may collect anonymised analytics data (pages visited, referrer, browser type) via Cloudflare's built-in analytics. This data is not linked to individuals.

4. Why We Collect It & Legal Basis

Account services — to create and manage your FAIRPLAY ID, send magic link login emails, and maintain your session. Legal basis: Contract performance and Legitimate interests.

Security — to protect against fraud, detect unauthorised access, and maintain session integrity. Legal basis: Legitimate interests.

Marketing communications — to send you updates about Fairplay Industries, new releases, and exclusive offers, where you have opted in. Legal basis: Consent. You may withdraw consent at any time.

Legal compliance — to comply with applicable UK law including data protection obligations. Legal basis: Legal obligation.

5. How We Store Your Data

Your data is stored in a Cloudflare D1 database (SQLite) hosted within Cloudflare's European infrastructure (EEUR region). Cloudflare acts as a data processor on our behalf and is subject to appropriate data processing agreements. All data is encrypted at rest and in transit (TLS). We never store passwords — authentication currently uses passwordless magic links. Passkeys remain disabled until full WebAuthn verification is implemented.

Your session is held in a secure, HttpOnly cookie set by our authentication server, which JavaScript cannot read; a small non-sensitive "logged in" flag is kept in your browser's local storage purely so the page knows which screen to show you.

6. Data Retention

Account data is retained for as long as your account is active. Sessions expire after 30 days of inactivity. Magic link tokens expire after 15 minutes. If you request account deletion, your account is deactivated immediately and permanently erased within 30 days. Newsletter contact data is retained until you unsubscribe or request deletion.

7. Third Parties

We use the following third-party processors:

Cloudflare — infrastructure, DNS, and database hosting. Privacy Policy

Brevo (Sendinblue) — email delivery for magic links and marketing. Privacy Policy

We do not sell, rent, or share your personal data with any other third parties for their own marketing purposes.

8. Your Rights Under UK GDPR

You have the right to: access your data; rectify inaccurate data; erase your data ("right to be forgotten"); restrict processing; data portability; object to processing based on legitimate interests; and to withdraw consent at any time where processing is based on consent.

To exercise any of these rights, email us at connect@fairplayindustries.com. We will respond within 30 days. Account deletion can also be requested directly from your FAIRPLAY ID dashboard.

10. Right to Complain

If you are unhappy with how we handle your data, you have the right to lodge a complaint with the UK Information Commissioner's Office (ICO) at ico.org.uk or by calling 0303 123 1113.

11. Changes to This Policy

We may update this policy from time to time. Material changes will be communicated via email to account holders. Continued use of FAIRPLAY ID after changes constitutes acceptance.

These Legal & IP Guidelines govern collaborations, intellectual property, and professional conduct at Fairplay Industries Ltd, registered in England and Wales, United Kingdom. By using our website or creating a FAIRPLAY ID, you agree to these terms. Contact us at connect@fairplayindustries.com.

2. Age Requirement

You must be at least 16 years old to create a FAIRPLAY ID or subscribe to our mailing list. By registering, you confirm you meet this requirement. We reserve the right to terminate accounts where we have reason to believe the age requirement has not been met.

3. FAIRPLAY ID Accounts

FAIRPLAY ID is a free account system providing access to exclusive discounts on upcoming Fairplay releases, early access to announcements, and will be required to access Fairplay games in future. You are responsible for the security of your account. You must not share your magic links or session credentials. We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to use our website or FAIRPLAY ID to: impersonate any person or entity; engage in any unlawful activity; attempt to gain unauthorised access to our systems; scrape or extract data without permission; transmit malware or harmful code; or harass, threaten or harm others.

5. Intellectual Property

All content on fairplayindustries.com — including text, graphics, logos, artwork, game assets, and the FAIRPLAY ID system — is the exclusive property of Fairplay Industries Ltd and is protected by UK and international copyright law. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

6. Disclaimer of Warranties

Our website and services are provided "as is" without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted or error-free. We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice.

7. Limitation of Liability

To the fullest extent permitted by UK law, Fairplay Industries Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or FAIRPLAY ID. Our total liability in any circumstance shall not exceed £100.

8. Privacy & Cookies

Your use of our services is also governed by our Privacy Policy and Cookie Policy, incorporated into these terms by reference.

9. Governing Law

These Terms of Use are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may update these terms from time to time. Material changes will be communicated to FAIRPLAY ID account holders by email. Continued use constitutes acceptance of the revised terms.

Cookies are small text files placed on your device when you visit a website. We also use browser storage technologies (such as localStorage) which function similarly. This policy explains how Fairplay Industries uses these technologies.

2. What We Use

Essential session cookie — We set a secure, HttpOnly session cookie to keep your FAIRPLAY ID signed in. This cookie cannot be read by page scripts and is strictly necessary for the account system to function. It persists for up to 30 days or until you sign out. We also store a small non-sensitive flag in your browser's local storage to control which screens you see; it has no authentication value on its own.

Cloudflare cookies — Cloudflare, our infrastructure provider, may set cookies such as __cf_bm (bot management, expires after 30 minutes) and __cflb (load balancing) for security and performance purposes. These are strictly necessary and cannot be disabled without affecting site functionality.

reCAPTCHA — Our newsletter form uses Google reCAPTCHA to prevent spam. Google may set cookies as part of this service. See Google's Privacy Policy for details.

3. What We Do NOT Use

We do not use advertising cookies, third-party tracking cookies, or analytics cookies that identify individual users. We do not use Facebook Pixel, Google Analytics, or any similar tracking tools.

4. How to Manage Cookies

You can control and delete cookies through your browser settings. Please note that disabling essential cookies may affect the functionality of the site, including your ability to stay logged in to FAIRPLAY ID. To clear your FAIRPLAY ID session, simply sign out from your account dashboard.
